Court-Martial or Adverse Action
International Military Court-Martial Attorneys
You could face a court-martial or some other type of adverse action if an investigation shows you may have violated the Uniform Code of Military Justice (UCMJ). The "Assimilation Clause" of Article 134, UCMJ, allows the military to prosecute you for a civilian crime not specifically listed in the UCMJ.
A finding of guilt can have severe implications for your future and result in harsh punishment, including a bad conduct or a dishonorable discharge, confinement, forfeiture of pay, and reduction in rank, among others.
There may be significant added consequences, such as sex offender registration, the inability to own or possess firearms, or removal from the U.S. if you are a green card-holding immigrant.
You should give us a call for expert advice as dedicated and experienced military law lawyers.
At The Law Office of Cave & Freeburg, LLP, we represent service members in the United States and at international installations worldwide.

Presenting a Strong Defense on Your Behalf
Our complete knowledge of military court procedures and the requirements for presenting a winning defense allows us to provide more effective representation to service members. We thoroughly review your case and the evidence that the prosecution will try to use against you. Because of our many years of appellate experience, we have a well-developed folder and ideas of pretrial motions to file in your case.
We have an "A" list of experts in various fields of study that we can call on for their expert assistance. In the right situation, the military will pay for the fees, not you. Any military defense lawyer must have a good understanding of forensic psychology, toxicology, DNA, computer forensics, and medicine to be effective. Our "A" list experts help us make our knowledge and experience effective on your behalf.
We rely on you to provide a complete and accurate account of your involvement in the case and use that information to build a compelling argument on your behalf. We will take every opportunity to get the charges against you dismissed without a trial. In 2023 (as in past years and as 2024 seems to be proving), we can successfully defeat cases before they get to trial. If a dismissal of the court-martial is out of reach, we will be fully prepared to litigate your case before the member's panel (the jury).
We have defended service members from paygrade E-1 through O-8 against a broad range of charges, including the following:
- Sexual assault (we have developed a sub-specialty of defending medical providers accused of sexual offenses while practicing medicine)
- We have experience representing appellants facing retrial after the appeals court has set aside the conviction (they can be more challenging than the first trial, partly because it has been years since the first trial)
- Other violence offenses, including assault, murder, and domestic violence
- Espionage or related national security concerns
- Drug offenses
- AWOL / UA / Deserter violations
- Fraud and theft offenses
- Aiding the enemy
- Fraternization
