On SCOTUSBlog there’s an interesting piece about ongoing litigation in Louisiana about Brady issues. A question: if the article is correct, does this not demonstrate that hortatory language is ineffective in getting prosecutors to follow the rules, or is it necessary to actually reverse a few cases.
